Appendix for European Economic Area

WHEN DOES THIS APPENDIX APPLY?

This Appendix forms part of the PPE Australia Privacy Policy and applies if you are based in the European Economic Area (EEA) during your interactions with us (other than where you are in the EEA solely for travel purposes). This Appendix sets out the additional information that we are required to provide to you under European data protection laws, including information about the additional rights you may have under European data protection laws. 

If you are based in the EEA, this Appendix should be read in conjunction with, and forms a part of, the PPE Australia Privacy Policy.

WHY WE COLLECT YOUR PERSONAL INFORMATION & WHO WE DISCLOSE IT TO
 

When we use your Personal Information, we take care to ensure that it is used in an appropriate way. Use of Personal Information (and special categories of Personal Information) under European data protection law must be based on one of a number of legal grounds and we are required to set out the grounds in respect of each use in the Privacy Policy.

LEGAL GROUNDS FOR USE OF PERSONAL INFORMATION

3.1       The legal grounds for our use of your Personal Information are as follows:
 

Consent: where you have consented to our use of your Personal Information. You may withdraw your consent to the use of your Personal Information by contacting us as set out at section 7 of this Appendix; 

 

Contract performance: where we are required to collect and handle your Personal Information in order to provide you with the services that we have contractually agreed to provide to you.

 

Legal obligation: where we need to use your Personal Information to comply with our legal obligations; and

 

Legitimate interests: where we have a legitimate interest in using your Personal Information. We will only rely on this legal ground if we consider that our interest in using your Personal Information for the relevant purpose is not outweighed by any interests that you may have, or any prejudice that you may suffer, from the relevant use of your Personal Information.

3.2       The legal grounds for our use of the special categories of Personal Information are:

Legal claims: where your Personal Information is necessary for us to establish, exercise of defend any legal claims; and 

 

Substantial public interest: where we need to process your Personal Information for reasons of substantial public interest set out in EU law or the laws of the member state in which you are based. 

 

EXPORTS OUTSIDE THE EUROPEAN ECONOMIC AREA
 

Your Personal Information will be accessed by staff or suppliers, transferred, and/or stored outside the EEA, including to the US and other countries which have a lower level of data protection than under EU DP law.

We must comply with specific rules when we transfer Personal Information from inside the EEA to outside the EEA. When we do this, we will use appropriate safeguards to protect any Personal Information being transferred.

Certain countries outside the EEA have been approved by the European Commission as providing essentially equivalent protections to EEA data protection laws (see the full list here http://ec.europa.eu/justice/data-protection/international-transfers/adequacy/index_en.htm) and therefore no additional safeguards are required to transfer Personal Information to recipients in these countries.  For other countries outside the EEA, we will transfer your Personal Information subject to European Commission-approved contractual terms that impose different data protection obligations directly on the recipient unless we are permitted under EU data protection law to make such transfers without such formalities.

RETENTION PERIODS
 

Our retention periods for Personal Information are based on our business needs and legal requirements. We will retain your Personal Information for as long as your User account is active and otherwise as long as is necessary for the processing purpose(s) for which it was collected and any other permitted linked purpose. Where Personal Information is no longer needed, we either irreversibly anonymize the data (in which case we may further retain and use the anonymized data) or securely destroy the data.

YOUR RIGHTS
 

6.1       Under certain conditions, you may have the right under EU data protection law to ask us to: 

provide you with further details on how we use and process your Personal Information;

provide you with a copy of your Personal Information that we hold; 
 

update any inaccuracies in the Personal Information we hold; 
 

delete Personal Information we no longer have grounds to process; 
 

ask us to transmit the Personal Information you have provided to us and we still hold about you to a third party electronically; and 
 

restrict how we process your Personal Information whilst we consider an inquiry you have raised.

6.2       In addition, under certain conditions, you have the right to:

 

where processing is based on consent, withdraw the consent; 

 

object to any processing of Personal Information that we process on the “legitimate interests” or “public interests” grounds, unless our reasons for the underlying processing outweighs your interests, rights and freedoms; and 
 

object to direct marketing (including any profiling for such purposes) at any time

These rights are subject to certain exemptions to safeguard the public interest (e.g. the prevention or detection of crime) and our interests (e.g. the maintenance of legal privilege). We will respond to most requests within one month.
